Prof. Thomas Powers Prof. Thomas Powers Professor Thomas Powers published an essay titled: “Is the ‘Ellerth-Faragher Test’ as Important as Brown v. Board of Education?” on The Constitutionalist website.

The essay makes the case for the illuminating importance of a somewhat obscure legal “test” used in employment discrimination cases, arguing that it shows how both workplace diversity training and the use of employee discharge (firing employees) is anchored in the law.
